Will of William Cullingworth, yeoman of Collingham. Signed 7 April 1799
In the Name of God
amen I William Cullingworth of Collingham in the County of York Yeoman
being of sound Mind and Understanding so make and publish this my last
Will and Testament in Manner following that is to say To my Son Edward
Cullingworth I give and bequeath the Sum of five pounds of lawfull
Money of Great Britain also the bed Bedding Bedstead and Hangings on which
he usually sleeps To my son William Cullingworth I give and
bequeath the sum of five pounds To Susannah Dalby the Wife of John
Dalby I give and bequeath the Sum of five shillings and to Maria
the Wife of Henry Midgley I give and bequeath the sum of five
shillings all which Legacies I will shall be paid within twelve months
next after my Decease All my Tenant Right and Interest of and to my Farm
and Premises at Collingham aforesaid I give and bequeathe to my Son
Johnathan Cullingworth All the Rest and residue of my Goods Chattles
ready Money Debts Securities for Money personal Estate and Effects
whatsoever I give and bequeath to David Midgley and William Midgley of
Bardsey Grange in the County of York Millers their Executors and
Administrators Upon Trust that they or the survivor of them his Executors
or administrators do and shall as soon as conveniently may be after my
Decease convert the same into ready money and place one full moiety or
Half part of the Produce thereof out at Interest in some public or private
securities according to his or their Discretion and pay and apply the
yearly Dividends and Interest of such Moiety or Half Part as the same
shall from time to time arise and be received unto my dear Wife and
her Assigns for and during the Term of her Natural Life and from and after
her Decease then Upon Trust to pay and divide the whole of the Principal
and Interest of the said Moiety or Half Part unto and equally amongst my
two Sons Henry Cullingworth and Thomas Cullingworth equally to be
divided between them Share and Share alike and if either of them shall be
then dead Then upon Trust to pay the Share of him so dying unto the
Survivor of them my two Sons Henry Cullingworth and Thomas Cullingworth
And in case both of then shall dye before their Legacy shall become
payable Then Upon Trust to pay the Whole of the Principal and Interest
then due thereon on the Decease of my said Wife to my to my Son Jonathan
Cullingworth or his next legal personal Representative or Representatives
And upon further Trust that they the said David Midgley and William
Midgley or the survivor of them his Executors or Administrators do and
shall within six calendar months next after my decease pay the other
moiety or half Part of the Produce of the said Residue of my Goods
Chattles ready Money Debts Securities for Money Personal Estate and
Effects unto my son Johnathan Cullingworth his Executors or Administrators
And I do hereby constitute and appoint the said David Midgley and William
Midgley joint Executors of this my last Will and Testament And it is my
Will and I do hereby expressly
declare that my said Trustees and Executors or either of them their or
either of their Executors or Administrators shall not be answerable for
more of the aforesaid Monies and Effects than he or they shall
respectively actually receive nor for any Loss which may happen of the
same or Securities for the same or any Part thereof
so as the same happen without their wilfull Default nor one for the
other or for the Acts Receipts Defaults or Disbursements the one of the
other but each them for his own proper Acts Receipts and willfull Defaults
only And that it shall and may be lawfull to and for my Trustees and
Executors and the Survivor of them his Executors or Administrators to
deduct and retain to him and themselves respectively all such Loss Costs
Charges Damages and Expenses as he or they or any of them shall or may
sustain expend or be put to for or by reason of the performance of this my
Will or the Execution of the Trusts hereby in them reposed or any Thing in
anywise relating thereto In Witness whereof I the said Testator William
Cullingworth have to each sheet of this my last Will and Testament t(he
whole whereof is contained in two sheets of paper) set my Hand and Seal
this second day of April in the year of our Lord one thousand seven
hundred and ninety nine

Job Barker & Henry Midgley A Declaration instead of an Inventory of all and singular the Goods Chattels and Credits of William Cullingworth late of Collingham in the Diocese of York Yeoman deceased made by David Midgley and William Midgley the joint Executors named in the last Will and Testament of the said deceased The said Executors declare that to the best of their knowledge and belief the said deceased’s personal Effects at the Time of his death would not amount to the Sum of three hundred pounds. Dated

David Midgley and William Midgley the joint Executors named in the within William Cullingworth late of the parish of Collingham in the Diocese of York Yeoman deceased were duly sworn before me
